We can go for a search in the house of the accused but it is also possible for that person not to let us in if we do not possess the right search warrant.
Says Jayanta Mukherjee, O.C. of Rabindra Sarobar Police Station.
Nobody wants to be caught just because they are not abiding the basic rules and regulations. Cops, as we all know, are our best friends, and are the only ones whom we can go to during any sort of problems. However, it is essential to know how we can help them work a bit faster and in a much methodical way. Even they should be cognizant of a few specifics in their job.
1. Supreme Court has set the rules that even if the police have the credible cause to be certain of illegal proceedings going on in a house, without a proper search warrant they have no right to enter your house and search. No matter how much serious the case is.
2. You are free to talk to any cop keeping your protective chain lock intact. Talk through the opening and do the needful. If they are carrying proper warrants please co-operate.
3. Behaving rudely is unprincipled and beyond law too. Be respectful to the cop and ask him the reason for the visit. If the cop is not carrying a warrant, tell him that you cannot let him in. For further encounter please consult a lawyer as soon as possible.
Most of us are not aware of these facts but we have taken up the initiative to spread the awareness among our naïve friends and family members.
