Further to several statements made by people ‘holding public office’, against the movie Padmavati (based on the historic battle between the Rajput ruler Ratan Singh of Mewar kingdom and Alauddin khilji of Delhi); Apex Court of India stated that such statements might prejudice the censor board’s decision ahead of the movie’s release.
The order was passed pursuant to statements issued by the Chief Ministers of Rajasthan, Gujarat and Madhya Pradesh who said that they will not allow the movie to release even if it is cleared by the censor board.
“The movie has still not got a certificate. What the CBFC will do is in its statutory realm. Why should anyone holding a responsible public office comment on the movie while it was still pending before the CBFC? Do not comment unless required whatever be the piece of art,” the Chief Justice of India stated.
While taking note of the statements made by politicians, the Apex Court added that, it should be borne in mind that we all are governed by the Rule of Law.
Furthermore, the bench also struck off a demand for filing cases against the producers and director of the movie for defamation and disrupting harmony, saying that such demands were “misconceived”.
Earlier last week, the Supreme Court quashed a petition seeking deletion of “objectionable scenes” from the movie stating that it was yet to be cleared by the Central Board of Film Certification (CBFC). The bench comprising of Chief Justice of India Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud opined: “We have been apprised that the film has not yet received the certificate from the CBFC… our interference in this writ petition will tantamount to pre-judging, which we are not inclined to do.”
